Terms of Service

Quotes & Estimates

• Written quotes are typically valid for 30 days unless stated otherwise.
• Estimates are based on the information and site conditions observed at the time of quoting.
• Hidden issues (e.g., water damage, mold, deteriorated substrates) may require a revised quote.

Scheduling & Site Access

• Start dates are scheduled on a first-confirmed basis and may shift due to weather or preceding work.
• Client must provide clear access, electricity, adequate lighting, and running water during work hours.

Preparation, Materials & Colour

• We protect surfaces, repair minor defects, sand, and prime as needed per quote scope.
• We use premium coatings specified in your quote; equivalent substitutions may be used if necessary.
• Client approves colours in writing prior to ordering paint; colour changes after approval may incur fees.

Safety & Compliance

Our crews follow applicable Ontario health and safety regulations and manufacturer specifications. We are insured and operate with WSIB coverage. Client agrees to keep the work area free of hazards and to promptly inform us of any safety concerns.

Payments & Invoices

• Deposit may be required to secure scheduling and materials.
• Progress or milestone invoices may be issued for multi-day projects.
• Final payment is due upon substantial completion unless otherwise stated on the invoice.

Changes, Extras & Cancellations

• Client-requested additions or deviations from the quoted scope will be priced and approved before proceeding.
• Cancellations within 3 business days of the start date may be subject to a fee to cover lost time and materials.

Warranty

We stand behind our workmanship. Defects in labour identified within a reasonable period after completion will be addressed at our discretion. Normal wear and tear, substrate movement, moisture intrusion, prior coatings failures, and damage caused by others are excluded. Manufacturer warranties apply to products used.

Photos & Portfolio

With your permission, we may take non-identifying before/after photos for records and portfolio. We will not disclose confidential client information or identifying details without consent.

Website Use & Intellectual Property

The content on our site (logos, graphics, text, layout) is owned by or licensed to Stark’s Painting and protected by applicable laws. You may not copy, modify, or redistribute site content without our written consent.

Third-Party Tools & Links

Our site may reference or link to third-party services (e.g., Google Maps, Google Ads, analytics). We are not responsible for third-party content or practices. Your use of those services is governed by their terms.

Limitation of Liability

To the maximum extent permitted by law, Stark’s Painting will not be liable for indirect, incidental, special, or consequential damages, or for loss of profits, revenue, use, or data. Our total liability for any claim is limited to the amount paid by you for the relevant services.

Indemnity & Dispute Resolution

You agree to indemnify and hold Stark’s Painting harmless from claims arising from your breach of these Terms or misuse of our site/services. These Terms are governed by the laws of Ontario and the laws of Canada applicable therein. Any disputes shall be brought in the courts of Ontario, located in Windsor, Ontario.

Communications (CASL)

We may send you service-related communications (quotes, scheduling, updates). Marketing emails or texts are sent only with appropriate consent. You can withdraw consent at any time using the instructions provided in our messages.

Changes to Terms & Termination

We may update these Terms from time to time. Continued use of the site or services after changes indicates acceptance of the updated Terms. We may suspend or discontinue services for any breach or for safety/operational reasons.
